Salam,
I am a newly married women. I was just wondering that if my husband and I can have a sexual intercourse after the 12th of Muharram? Can couples engage in a sexual relationship in the month of Muharram or is it prohibited? Thank you.

From the Fiqh / Jurisprudence perspective: It is Mubah ( optional ).

Taqlid is only in Fiqh/ Jurisprudence / Law. The Islamic Scholars divide Islamic Instructions in three parts, 1) Fundamental of Faith (Aqidah ) 2) Islamic Ethics/Morals 3) Islamic Law. If something is Mubah ( Optional) from the law perspective, you would take other instructions / personal / situation specific factors into consideration.

Awareness of the Calamities and Tragedies which befall the captives  after the Ashura, from Karbala to Kufa(Iraq) to Damascus ( Syria ).  We humans do not engage in certain things during personal tragedies even if it is Mubah (optional ). It is Makrooh (Not Recommended ) to be happy / feel pleasure or show happiness / pleasure during the Mourning period. If people abstain from certain pleasures or things or events  during the mourning period, it is due to their understanding of the Tragedy, Ma’rifa /  their connection with the household of Sayyida Fatima al-Zahra (sa). These things they abstain from increase their spirituality.

Imam Ridha’ (A.S.) said (to Ibn Shabib):

قال الرضا (ع):

يا بن شبيب إن سرَّك أن تكون معنا في الدرجات العُلى مِن الجنان فاحزن لِحُزننا وافرح لِفرحنا

O’ Son of Shabib! If it makes you happy (and you desire) to be with us in the elevated ranks of paradise, then be sad in our grief and happy at our happiness.
