I am a young 25-year-old university student, and I am interested in the issue of temporary marriage (muta\’h). Due to my financial constraints, I do not have the possibility of getting married in a conventional manner, but I wish to respect Islamic values and avoid falling into zina. This is why I am trying to understand the implications of muta\’h.
I know that it is possible to make a muta\’h with a woman (People of the Book) with the agreement of her wali. However:
1. Can I make a muta\’h with a woman who has been in a previous relationship, but who has not been married before (extramarital relationship, as there are many in the West), knowing that she lives alone and is totally independent of her family?
2. What about a divorced or menopausal woman? Do I also have to obtain the agreement of her wali? And for the menopausal, do I need to respect the continence period ?
3. Can I perform (temporary mariage) muta\’h with an escort/prostitute if I have confirmation that she has completed her period of continence? Do I also need to obtain the agreement of her wali? Do I also need to respect the continence period if she is menopausal ?
4. Can I proceed to a temporary marriage with a Christian, Jewish or Muslim woman, even if she is not a practicing person?
5. Can I trust any woman if she tells me that she has completed her period of continence or that she is from one of the three faiths?
6. Regarding the contract, if she refuses to receive a dowry (money, etc.), can I establish a contract without mentioning the dowry?
7. If I wish to perform muta\’h with a Sunni woman, can we establish two contracts for each of the madhabs, namely one for muta\’h and another for mysiar?
I have read several opinions on this subject, but I still feel a little lost. I have prepared all the questions that came to my mind, but I may have forgotten something important. So I would appreciate any other advice or resources you could recommend to me regarding muta\’h marriage.

  1. If she is not married legally or religiously, you can temporarily marry her.
    2. In either case, you don’t need permission from the wali. However, in the case of menopausal, there are further details. If interested in knowing more, please call us at (718) 297-6520.
