Forcing hijabCategory: QuestionsAuthor "mehdi@al-khoei.org"Forcing hijab
Abbass asked 1 year ago

I told my wife to wear hijab. Although she doesn’t want to carry it. Forcing her to wear it leads to fights and arguments.
Am I allowed to force her to wear hijab. Is there any compulsion in Islam?

عوذ بالله من الشيطان الرجيم

As Salaamu Alaikum Wa Rahmatullahi Wa Barakatuh,

Based on your specific question and information provided.

The Islamic Scholars have divided the Islamic teachings in three parts. (1) Fundamental of Faith ( Belief / Aqidah), (2) Islamic Ethics / Morals, and (3) Islamic Law/ Fiqh / Jurisprudence. The “institution of  Marriage” is covered by all three. The “Marriage Contract” is cover by Islamic Jurisprudence.

Before looking at the options from the Islamic Law / Fiqh, which is a safety net, a last resort. We live our lives in accordance with the teachings of Hadith al-Thaqalan – The Qur’an and the Ahlul Bayth (a.s), meaning we take direction in choosing our marriage partner and living our married lives from The Qur’an and the  Ahlul Bayth (a.s).

If you married your wife and she was not wearing a Hijab, you need to educate her. Explain the philosophy behind the Islamic Modesty from the Qur’anic point of view and point towards the lives of the Ahlul Bayth (a.s).

Regarding Compulsion in Islam. There is no compulsion in Principles of Faith ( Usul al-Din) . However, once you accept the faith out of your freewill, A believer (mukallaf)  is legally obliged to fulfil religious duties.

Here is some information you can use.

Hijab

Woman should conceal all her body (including arms and legs) and hair from a man who is non-Mahram, and as an obligatory precaution, she should conceal herself even from a Na-baligh boy who is able to discern between good and evil, and could probably be sexually excited. But she can leave her face and hands upto wrists uncovered in the presence of Na-Mahram, as long as it does not lead him to casting a sinful, evil glance or her to doing something forbidden; for in both these cases, she must cover them.

Al-Amr bi ’l-Ma‘rûf and an-Nahi ‘ani ’l-Munkar

Enjoining good and forbidding evil are obligatory rituals, whenever the conditions exist, on all believing men and women. Almighty Allah has said in His noble Book: “There should be a group among you who should be calling (people) to the good, enjoining the good, and forbidding the evil; they are the successful ones.” (3:104) He also said, “The believing men and the believing women are helpers of one another, they enjoin the good and forbid the evil.” (9:71)
Our noble Prophet Muhammad (s.a.w.) said, “My community will continue to be blessed as long they enjoin the good and forbid the evil, and help one another in good deeds. When they do not do this, blessings will be withheld from them, and some [evil persons] among them will have hegemony over the others; and they shall have no helper neither on the earth nor in the heaven.”

Husband and Wife Interaction.

Among the qualities of a good wife is refraining from harassing, hurting, and irritating her husband. Among the qualities of a good husband is refraining from harassing, hurting, and irritating his wife. The Prophet (s.a.w.) said, “If a man has a wife who harasses him, Allah will neither accept her ritual prayer (salat) nor any of her good deeds —until she has pleased him— even if she fasts and prays at all times, emancipates slaves, and gives away her wealth in charity for the sake of Allah. She will be the first to enter the Fire.” Then he said, “And the husband has the same burden and chastisement, if he is a harasser and unjust [in his behaviour towards his wife].”

Spouse Selection.

Man should give importance to the qualities of the woman he would like to marry. He should not marry except a woman who is chaste, honourable, of good lineage, and righteous. She should be a source of help to him in the affairs of this world and the hereafter.
Man should not confine his choice to the woman’s physical beauty and wealth. It has been narrated from the Prophet (s.a.w.) that he said, “O People! Beware of the green grass [growing] in a waste site.” Someone asked, “O Messenger of Allah! And what is the green grass in a waste site?” He replied, “A beautiful woman in an evil environment.”
